Germantown prosecutor resigns after arrest

MEMPHIS, TN -(WMC-TV) – Joe Lee Wyatt, Germantown’s senior prosecutor, is off the job after he was arrested for driving drunk with a loaded handgun in his car Tuesday evening.

Police say Wyatt drove off after smashing his BMW into a telephone pole on West Trigg.

A witness thought Wyatt might be drunk and called police as he followed the attorney to I-55, according to court records.

Investigators say Wyatt told an officer that another car ran him off the road, causing the crash. However, the officer said he saw no evidence that another car was involved.

The officer, according to court documents, also spotted an empty holster strapped to Wyatt’s hip. The loaded gun was later found in the driver’s seat.

Wyatt has been charged with reckless driving, DUI, possessing a handgun while under the influence and refusal to submit to a sobriety test.

    There’s something about this guy refusing the tests that seems quite interesting: He’s a prosecutor and knows full well what he’s doing here.

    Could a smarter mind than mine explain what he’s up to? I mean, the common schlub is always told he’d better blow/consent to blood tests…whatever, or he’s in big trouble.

    Is he doing what smart people do: Keep your freak’n mouth shut and consent to nothing.

  2. The only thing that comes from submitting to any roadside field sobriety tests. Then a test of blood or breath is to hand the police all the evidence they need to charge and convict you of DUI on a silver platter.

    By refusing any and all tests you run the risk of having your license suspended for 6 to 12 months. But it makes it that much harder for the police to bring a case against you in court.

    If more people refused everything, remained silent, then hired a lawyer with the full intention of going to trial.

    You would see ALOT of these cases dismissed before they ever saw the inside of any courtroom.

    For reasons passing all understanding the people are always all to eager to help the cops put you in jail.

    The 5th Amendment was written for a good reason, people need to understand it and exercise it!
