Tenn. Supreme Court Overturns Death Sentence Because of Prosecutorial Misconduct

NASHVILLE, Tenn. (AP) — The Tennessee Supreme Court has overturned a death sentence for a man convicted of murdering a Scott County couple in their bed and has ordered that a new jury decide whether to execute the inmate or spare his life.

The state’s highest court said Tuesday that prosecutors committed misconduct by making inappropriate statements to the jury during the murder trial of Hubert Glenn Sexton. The court also found that some evidence should not have been admitted because it was highly prejudicial.
